and wife Rachel, of Shenandoah County, Virginia and Augustine Bushong and
wife Barbara of County of Fairfield, State of Ohio sold their undivided shares
of fifth parts in the Lots in Woodstock #88 and #41 to John Effinger for
$150.00 consideration belonging to their father John Jacob Bushong deceased. John Bushong V and Elizabeth Sprinkle had TWO SONS named JOHN


John VI was born in 1756, and his brother, Johann Jacob was born in 1754.
Their parents, John Bushong V, and Elizabeth Sprenkle named their first son Johann Jacob and another John. In the period Johann was added as an affirmation of faith as in "with God." An early and automatic translation of Johann to John should not have been made and has caused a lot of confusion. Ultimately, John IV and Elizabeth never meant for their first son to be called John but rather Jacob.

The following is correct for the two brothers.
John Jacob 1754-1830, husband of Eva Catharina Bossert, was born in Pennsylvania and died in Ohio.
John VI, 1756- before Apr 1796, husband of Elizabeth Wendel, was born in Pennsylvania and died in Virginia.

DECLARATION was made in Columbiana County Ohio, May 15, 1818 by Jacob Bushong, a soldier of the Revolutionary war.

The data furnished below were obtained from papers on file file in the Pension Claim S 9247 based upon his said service.

He enlisted - place not stated, served as private and artificer with the Virginia troops under Capt Francis Cowherd and was discharged January 17, 1782 from Capt Francis Cowherd

COMPANY in the Second Virginia Regiment, having servred eighteen months He was in the battle of Guilford Court House, was wounded in the battle of Camden or Hobkirk's Hill, and was in the Siege of NINETY-SIX and the battle of Eutaw Springs.

In 1828 he was living in STARK COUNTY OHIO. There are no data relative to the soldier's family.
The above noted is the history of the only soldier named Jacob Bushong, searched under all spellings, that is found in the Revolutionary War Records of the National Archives.

THIS INDENTURE made the 30th day of September In the year of Our Lord one
thousand Seven hundred and ninety Two Between Jacob Bushang and Eve his
(one of the daughters of George Peter Bosset deceased) of the County of
Shanandoah and State of Virginia of the one part and George Bible of the
County of Rockingham and State aforesaid of the other Part. Whereas George Peter
Bosset being Seized in his lifetime of the fee simple Estate of a Certain Tract of
Land lying and being in the County of Pendleton /formerly Augusta/
Containing ninety seven acres on the South fork of Richardsons Lick run a Branch of the
South Branch of Potomack and Bounded as followeth: Beginning at a white oak
and Chesnut Oak Thence South forty four Poles, East one hundred and Twelve
Poles to a Hiccory and white oak South fifty eight degrees West one hundred
and eighty Poles to two Hiccories Thence South Eighty degrees West Thirty poles
to three Chesnut Oaks Thence North Twenty degrees West forty poles to two
Chestnut Oaks and Maple North forty one degrees East One Hundred and eighty
Seven Poles to the Beginning It being the same Tract of Land which was
purchased by the aforesaid George Peter Bosset in his lifetime from Charles Powers as
by his deed of Bargain Sale now of Record in the County Court of Augusta
reference being thereunto had may more fully appear. And the said George
Peter Bosset departed this life Intestate leaving no Issue only three daughters to
wit: Christina Bosset, Mary Catharine Bosset and Eve Catharine Bosset to
whom the aforesaid Tract of Land descended in Coparceners by reason whereof the
said Eve wife of the said Jacob Bushang became entitled to one third part of the
aforesaid Land as one of the Parceners and Representatives of the aforesaid
George Peter Bosset deceased. and the said Jacob Bushang subsequent to his
Marriage with the Eve purchased the part of Mary Catharine Bosset another of
the Coparceners and Representatives of the said George Peter Bosset deceased. Is
now become seized of two undivided Parts of the aforesaid Land. WITNESSETH
that for and in Consideration of the Sum of fifty Two pounds Five shillings
Current money of Virginia to the said Jacob Bushang and Eve his wife in hand
paid by the said George Bible at or before the Sealing and delivery of these
present the Receipt whereof they do hereby acknowledge and thereof doth
Release Acquit and discharge the Said George Bible his heirs Executors and
Administrators by these Presents; that they the said Jacob Bushang and Eve
his wife Have granted Bargained Sold Aliened and Confirmed unto him the said George
Bible his heirs Executors and Administrators the Two undivided parts of the
aforesaid Tract of Land lying and being in the County of Pendleton as
aforesaid And all Houses buildings Orchards Ways Waters Watercourses Profits
Commodities Hereditaments and Appurtenances to the said whatsoever to the said Two
undivided parts Belong as in anywise appertaining and the Reversions TO HAVE
AND TO HOLD the Land and Hereditaments and all its appurtenances unto the said
George Bible his heirs and assigns to the only proper use and behoof of him
the said George Bible his heirs and assigns forever. And the said Jacob Bushang
for himself and his heirs the two undivided parts of the aforesaid Tract of
Land Hereditaments and premises to the said George Bible his heirs and
assigns against the Claim and demand of him the Said Jacob Bushang and his heirs and
all and every other Person and persons whatsoever Shall Warrant and forever
defend by these presents....free and Clear of and from all former and other
Gifts grants Bargains Sales dower Right and Title of Dower Judgments
Executions Titles Troubles and Incumbrances whatsoever.

Tract purchased by George Peter Bosset dec'd from Charles Powers, the deed of record in Augusta Co. Bosset died intestate survived by three daughters:Christina, Mary Catharine and Eve Catharine. Jacob Bushong has, since the marriage, purchased the interest of Mary Catharine Bosset in this tract, and he and Eve convey the two shares to Bible for 52 pounds. The Revolutionary War Pension application of Jacob Bushong, dated at Columbiana Co OH 15 May 1818 for his service as a private, artificer and gunsmith in the Virginia Line, gives his age as SIXTY FOUR YEARS (1818-64 = born 1754). This application gives details on the battles in which he fought, and his leg injury. (National Archives, Revolutionary War Invalid Pension #9297, for Jacob Bushong) Note that this piece of evidence stating his age exactly matches his baptism date.

The Case of Mistaken Identity and Murder: The Story of Jacob and Samuel Bushong

If you would visit Grand View Cemetery in Carrollton, Ohio, you will find the grave of the cemetery’s only Revolutionary War Veteran. Underneath an impressive marble slab lies the body of a man who fought for this nation’s independence and blazed a trail into the frontier; building a solid foundation for his family and the newly formed village in which they lived. However, the name etched into the weathered marble headstone is not the name of the man buried beneath it.
Upon discovering the burial place for this Veteran of Independence, you will read will read carved into the tarnished marble: “Samuel Bushong Died 1829 Fought Under Baron Steuben in the Revolutionary War.” Not only is that the wrong name but also the wrong service record. The name of the true Revolutionary patriot is not Samuel Bushong, but his father Jacob Bushong.
In all of the early histories of Carrollton and Carroll County, the same oft-repeated mistake is made, and therefore, built upon and recognized as fact. In the Carrollton Centennial published by the Free Press Standard it states, “Samuel Bushong – A native of Hesse Darmstadt, Germany; came to America with Baron Steuben and fought for the colonies in the Revolutionary War; he died here in 1835 and was buried in “the honors of war”; his unmarked grave is near that of Peter Bohart. He built the two story log house still standing east of Robert’s Park, in 1820.” This simple paragraph was repeated in many subsequent histories causing the truth to fall between the cracks. How and why this occurred is not clear, but it is finally time to right this wrong, and to do this all of the facts need to be looked at. Since this is the story of two men it is only proper that both of their stories be told.

Jacob served in the2nd Regiment of the Virginia Line in a company commanded by Captain Francis Cowherd. To best understand Jacob Bushong’s service record, its best to look at the pension application he filed on May 15, 1818. He states that sometime in 1780, he enlisted with Captain Ransdal, but was transferred to the company commanded by Captain Francis Cowherd after Ransdal resigned. He served with Captain Cowherd as both a private and as a gunsmith for the duration of enlistment. He further related in his pension application that he was never paid for his service as a soldier, but just irregularly when performing the task of artificer of a gunsmith and blacksmith. Moreover, he served in the battles of Guilford, Camden, Eutaw, and at the Siege of Ninety-Six. Furthermore, during the Battle of Camden his shin bone was broken and never properly healed. This led to a running sore which cost him a lot of money, and was the driving force behind him filing for a pension.
In response to this pension application he was awarded $72.53 and his name was dropped from the Pension Roll under the Act of May 1, 1820 due to owning several pieces of property. After a new pension act was passed by the government on May 15, 1828, Jacob Bushong went before the court in Stark County on October 13, 1828 and again applied for a pension. Again, Jacob was denied his pension.
After Jacob returned home following the war in 1783, he began to court Eva Catherina Bossert, the daughter of George Bossert of Shenandoah County, Virginia. They were soon married on January 1, 1784. Jacob and Eva then purchased land in Shenandoah County on the banks of the north branch of the Shenandoah River. Here was born eight of their nine children; John (1785), Elizabeth (1786), Catherine (1791), Samuel (1794), Sarah (1797), George (1804), William (1805) and Jacob (1806). They sold off a portion of this land in 1796, and completely moved to Unity Township in Columbiana County, Ohio in April of 1807. It was here that Jacob and Eva’s final child was born in 1807, a boy named Peter.
While residing in Unity Township, Jacob was elected as a representative in Ohio’s General Assembly in 1812. He was an important member as once again America was engaged in a war with England. Therefore, not only was his experience in the Revolutionary War invaluable with passing legislature involving the state’s war effort, but Jacob’s oldest son was serving a lieutenant in the Ohio militia and provided firsthand accounts of the war to his father in Chillicothe. During this same tenure Jacob sold his newly married son John, a portion of land within Unity Township. After his service in the General Assembly, Jacob soon began looking for new opportunities in the growing state.

In 1819, Jacob moved his family to Centerville, Columbiana County (present day Carrollton, Ohio), and purchased lot #55 from Peter Bohart. Jacob purchased additional lots (#71 and #76) in 1820, from Andrew Moore and George W. Butler. On lot #71 Jacob built a two story log cabin for his family, while simultaneously helping his son Samuel build a house next door on lot #73. In 1829, Jacob purchased additional land from Dickerson Roberts, lots # 73 and #74. It was on lot #73 that Samuel erected a two story log cabin for his family to live in 1820, and it was this structure that was described in the Carrollton Centennial. He had sold the lot on April 1, 1820 to Dickerson Roberts who in turn sold it to Jacob, thus adding to the confusion of the two. On the 9th of January 1830, Jacob sold lots #26, 94, and 95 to his son, Samuel for $175.

Jacob passed away in August of 1830, as his will which was dated May 9, 1827, was probated in Stark County on August 16, 1830. At this point Jacob owned a large piece of land within Section 2, Township 15, Range 6, this land was located just northwest of Centerville by a quarter of a mile and was in Stark County. (This is along current day Canton Road, in the corporation limits of Carrollton.) This land would ultimately be involved in a court battle involving Jacob’s heirs in 1832. Eva Catherina Bushong would survive for six years after Jacob’s death, passing away on July 5, 1836. She was laid to rest beside her husband in an unmarked grave in Grandview Cemetery.

All of this information not only proves that Jacob was the true Revolutionary War, but that he did not die in 1829, was not a native of Germany, and furthermore did not serve under Baron Steuben (the 2nd Continental Line served under General Nathanial Greene). The question is then, what happened to Samuel Bushong.
Samuel Bushong first appears in the records after his father’s death in 1832, listed as a defendant in his sister suit against the heirs of Jacob Bushong. The next time he appears on record is when he and his wife, Margaret, along with their four children moved to Richland County, Ohio in 1837. Samuel purchased thirty-five acres of Section #26 in Jefferson Township for $800. He paid $400 down and secured the additional $400 by getting a mortgage.
However, in the summer of 1840, Samuel had defaulted on his mortgage and his property was up for Sheriff’s sale. Samuel tried to obtain the needed money to pay off his debt from his friends and family, but came up short. On October 3, 1840, Samuel was seen in the town of Bellville casting his vote in the election, before returning home.
Early the next morning, news was spread throughout the area that Samuel Bushong had gone mad and murdered his family. What was soon discovered by Samuel’s neighbors was a gruesome site, as no non-Indian related murders had ever occurred in Richland County before this day. The first person found in the house was the body of Margaret Bushong. She was discovered lying before the fire upon the hearth, in front of the chair she was sitting in browning coffee in a skillet. Samuel had approached her from behind and struck her head with a fatal blow from an axe knocking her out of the chair. Samuel then went upstairs to his daughters’ room. His twenty-two year old daughter received a heavy blow across her face from the broad-end of the axe, yet her skull was not broken. His fifteen year old daughter was his next victim, receiving a blow across the face from the blade of the axe causing a deep wound spanning from above her left eye to beneath her right eye. After Samuel finished in this room he went to the adjoining room where his sons were sleeping.
However, the boys were awakened by their father’s rampage in the room next to their and saw him enter their room. Upon seeing the head of the axe glimmer in the moonlight as it was raised above the youngest son, the boys jumped their father and wrestled away the axe from his hands. The oldest son received a horrible cut across the arm while the youngest was hit from the poll of the axe. However Samuel did not give up on his assault, as he pulled out a razor blade and resumed the deadly struggle. After again losing his weapon to his sons, Samuel fled the house for the woods, while the two boys sought help from their neighbors. Surprisingly all of Samuel’s children survived the ghastly encounter.
Samuel was soon captured by a small posse of neighbors and led to town after narrowly escaping a lynch mob. The group was met a mile out of Bellville by the Constable and led to Mansfield for questioning. Upon interrogation Samuel admitted that the financial burden was the cause of the murderous rage, as his wife refused to sell the farm to get out of the debt and Samuel felt they were better off dead than to be beggars. All through the questioning Samuel remained calm about the ordeal, yet upon the route to the jailhouse he tried once again to escape and upon capture began to moan uncontrollably like he was in great agony and distress.
Samuel’s trial began July 10, 1841 and lasted six days before a quick verdict was handed out. Samuel was found not guilty by reason of insanity, and forced to leave the county. Samuel then disappears from all records, and it is not known if he died b
efore the 1850 census or if he changed his name and faded into oblivion.
Today, Samuel’s name only lives on as a murderer in Richland County and a patriot hero in Carroll County, thanks to be mistaken for his father. The marble headstone was placed to the “patriot” Samuel was installed around 1915, sometime after the Carrollton C
entennial. The one justice that has been corrected is two bronze markers have been installed in Grandview Cemetery for Jacob and Eva Catherina Bushong. However, the common mistake of mixing the two up still persists. Along with the markers in Grandview Cemetery, one of the homes built by the Bushongs can still be seen today on lot #73 in Carrollton. (Another mix up often occurs here as another log cabin built by Jacob Bushong located on the adjoining lot was torn down in 1982, so it is often assumed that none of the Bushong’s homes still remain).
It is the simple hope of the writer, to wish that for once and all; the patriotic service and recognition is finally bestowed upon Jacob Bushong. Moreover, that his true service and history is realized, for he was a veteran of the Revolution, Representative in the General Assembly, and a true pioneer. From the Bushong Bulletin Vol 5 #3

Among the possessions at that sale were John Bushong Junior's Bible, Gun,
Bayonet and Sisk.(Used when in the Revolutionary War.) Augustine Bushong is named in the Shenandoah County Virginia Minute Book as
one of underage children of John Bushong Jr. who was a Revolutionary War
Soldier. John Jr. served in the Third Battalion of the Associators as a Private in
Company 6 under his Uncle Captain George Long. His father John Bushong Sr
served as a Lieutenant under the same Battalion but in the 2nd Company of
Captain Godfrey Fry. Anyone from this lineage should be eligible for either DAR or
SAR. There should be no question as John Jr.'s estate reflects the sale of
his weapons used in the Revolutionary War.

Between John Bushong and Magdalene his wife of Shenandoah County and
Augustine Bushong and Barbara his wife of Columbiana County and State of
Ohio to Adam Sine of said County of Shenandoah for Consideration of two hundred
dollars a tract of land lying and being on and near Stony Creek containing one
hundred and forty five acres and is the same tract of land whereof John
Bushong Junr, father of the said John and Augustine, died seized and they are
entitled to one undivided fifth each.

George Fravel was twenty-four and Elizabeth Bushong was twenty when they married on May 19, 1780 in Shenandoah County, Virginia.

George was engaged in farming and keeper of a tavern in Woodstock at the time of the stage line.

The 1820 census revealed George was a farmer and they were living in Shenandoah County, Virginia. They had one son (16-25), one son (26-44), one daughter (26-44), one male slave (15-26), one female slave (under 14), one female slave (26-44), one free colored male (under 14) and one free colored female (15-25) living with them.

Besides the 152 acres of land that George Fravel inherited from his
father's Will, George Fravel received a land patent for 151 acres surveyed 19 May
1796 and granted 24 October 1798.

Daniel Bowman, Frederick Dellinger and others.

The property that George inherited from his father is located east of
Woodstock. If you start at the old courthouse in the center of the town of
Woodstock and follow Court Street east picking up Route 758 out of town in the
county and at the intersection of 758 and 668 turn right and go south and
take the first fork, you cross the Shenandoah River and come to a private
road with a gate. This is the Dellinger property. Beyond that is the Fravele
property which in the future, I have been told, will be a State Park.

George Fravel Sr. also owned two lots in the town of Woodstock, #84 and
#45, one was a tavern.He sold these lots in 1818. He died 19 May 1823 at the
age of 67 years, 10 months and 20 days. He is buried in the Old Reformed
Cemetery located in Woodstock at the intersection of South Street and Church
Street. This property was where the St. Paul's Reformed Church was located

said slaves pursuant to the Act of Assembly in such cases made and
provided, and also alledging that Isaac Fravel, another of the sons and
distributees of said George Fravel, deceased, is no inhabitant of this Commonwealth;
On the motion of said Henry Fravel and others, it is ordered, that the said
Isaac Fravel do appear here on the Monday before, the second Tuesday in
January next, and shew cause if any he can, why the said negroes shall not be
sold and the money divided among the heirs and distributees of the said
George Fravel Senior, deceased according to law, and that a copy of this order
be forthwith inserted in the Shenandoah Herald for two months
successively, and that another copy be posted at the front door of the Court House of
this county,

A look at an excerpt from the will of Philip Bushong (Last Will and Testament of Phillip Bushong. 7 Feb 1785. Proven 26 Feb 1785. Register of Wills, Washington County Courthouse, Maryland. Will Book A, Pages 107-9) records his children:

I leave and bequeath unto my nine children viz as follows except sundry legacies hereto mentioned. John Bushong, Barbary wife of Henry Hardman, Phillip Bushong, Peter Bushong, Henry Bushong, Mary Bushong, Jacob Bushong, David Bushong, Elizabeth Bushong to be equal divided between them.

So we learn that Philip Bushong who died in Washington County, Maryland, did indeed have four children named John, Jacob, David, and Elizabeth. It seems that Philip listed his children in order of their birth because Jacob, David, and Elizabeth are listed last. It would be very unlikely that there were two Philip Bushong's who both died in 1785 with their youngest three children named Jacob, David, and Elizabeth. These two references to Philip Bushong are almost certainly one and the same. The
reference in the 1800 census is probably to Philip Bushong's (d. 1785) son Philip. Who is listed as the third child in his father's will.

"In the name of God Amen. I Peter Bushong of the County of Shenandoah and
State of Virginia, do hereby make my last will and testament in manner and form
following that is to say:
FIRST my two sons Philip and Peter Bushong are to pay my Just debts and
funeral expenses.
SECOND I give to my beloved wife Barbara the house at present occupied by us
during her natural life, and I also give to her all the furniture ready money
and other property which maybe in the same at the time of my death, She to
have the use of the furniture and other property during her natural life, and
after her death it is my will that all the effects she may leave behind Shall
be sold by my executors and the money arising from the sale of her property
together with what ready money she may have behind be equally divided among
my children and their heirs. In addition to what I have willed my beloved wife
I give her the following items to be furnished by my two sons Philip and Peter
Bushong annually TO WIT: Twenty five bushels of good clean wheat, fifteen
bushels rye, fifteen bushels corn, four bushels potatoes also what apples she
may want, one half barrel vinegar, six pounds coffee, six pounds sugar, two
hundred pounds pork, fifty pounds beef, seven pounds wool, five pounds
hackled flax, and also to deliver and cut what fire wood she may want. I also give
to my wife one horse and cow to be fed and taken care of by my two sons
before named. My wife also to have what land she may want for a garden, and also
the use of as much of the spring house as she may want to keep her butter and
milk in. The above bequests to be her full share of my estate real and
personal.
THIRD I give to my two sons Philip and Peter Bushong jointly the tract of
land on which I at present reside lying in the county of Shenandoah and State of
Virginia containing three hundred and thirty seven acres be the same more or
less, This I give to them and their heirs forever.
FOURTH whereas my son Abraham Bushong has already received his full share of
my estate real and personal I give him nothing more except what may fall to
his share at the death of his mother or the death of my Granddaughter
hereafter named.
FIFTH I give to my daughter Lydia Knop One Thousand dollars to be paid to
her by my two sons Philip and Peter in the following manner TO WIT: Five Hundred
dollars at the date of these presents andfive Hundred dollars in two years
thereafter, this to be her full share of my estate both real and personal

SIXTH I give to my Granddaughter Mary Ann Bushong (she being daughter to my
deceased Son Jacob Bushong) Nine hundred dollars to be paid to her by my two
sons Philip and Peter Bushong when the said Mary Ann Bushong arrives at the
age of twenty one years, but should the said Mary Ann Bushong die before she
arrives at the age of twenty one years, then in that event it is my will that
the said Nine hundred dollars should be equally divided amongst my four
children TO WIT: Philip Bushong, Peter Bushong, Abraham Bushong and Lydia Knop and
their heirs.
SEVENTH whatever property I may be in possession of at the time of my death
not already devised I give to my two sons Philip and Peter Bushong and their
heirs forever.
AND LASTLY I do constitute and appoint my two sons Philip and Peter Bushong
executors of this my last will and testament hereby revoking all other or
former wills or testaments by me heretofore made.

said Henry Bushong senior hath and by these presents doth for and in
consideration of the Sum of One dollar to him the said Henry Bushong senior in hand
paid by the said Henry Bushong junior the receipt whereof is hereby
acknowledged Grant bargain and sell unto the said Henry Bushong junior his heirs
Executors or administrators a certain Tract or parcel of land granted unto the said
Henry Bushong senior by the Commonwealth of Virginia on the twenty seventh

and Convey the said Land at publick Sale to the highest bidder for ready
money and out of the proceeds of said Sale pay the costs attending the sale and
Two hundred Dollars with legal Interest from the date hereof unto Philip
Bushong or his legal representatives which sum of money is justly due unto said
Philip Bushong from said Henry Bushong senior and if there shall be any money
left in the hands of said Trustee after paying the charges of said Sale and
the debt and cost of the sale the said Henry Bushong junior trustee shall pay

thousand eight hundred twenty two between Walter Newman of the County of
Shenandoah and State of Virginia of the first part and Henry Bushong of the same
County and State aforesaid of the second part. Whereas Henry Bushong being
indebted to a certain David Cook of the County of Shenandoah in the following sums
of money VIZ: A note of $50 dated the 16th day of March 1813 and becoming due
the 16th day of March 1817 one other note of $50 dated as above and becoming
due on the 16th day of March 1818, also one other note bearing date the 19th
day of November for $140.13 payable on demand and also one other note dated
the 16th day of March 1813 and becoming due on the 16th day of March 1820 for
$25. And said Henry Bushong being desirous to secure the said several sums of
money to the said David Cook in consideration thereof executed on the 17th
day of January 1820 a Deed of Trust to the said Walter Newman (or Trustee) for
"all that tract or parcel of Land lying and being in the County of
Rockingham and State of Virginia containing one hundred and twelve and three quarters
acres of land" be the same more or less and is the same Tract of Land which
the said Henry Bushong purchased of a certain John Minnick and adjoining the
lands of Michael Loar and others and is bounded as follows: BEGINNING at two
pines corner to Groves Land and then with his line North 45 West 236 poles to
a Spanish Oak in said Groves line thence North 59 1/2 East 79 poles to two
Black oaks saplings on the County line and with the same South 49 degrees East
201 poles to a Locust in said County and Patent line and thence crossing the
Tract South 34 degrees West 96 poles to the Beginning as by a refference to
said Deed of Trust of record in the County Court of Rockingham Will more fully

the Honorable Thomas L. Williams Chanceller upon the Bill of the
Complainant exhibits and proofs and it appearing that Judgment pros sessions have been
regularly entered against the defendants and the cause set down for hearing
exparte according to the course of the Court and the Chanceller being of
opinion that the complainant is entitled upon the part of the conveyance from the
defendant Philip Bushong to complainant Marked Exhibit C to complainants
Bill to have the legal title to Tract of land in exhibit A to complainants Bill
described divested out of the defendants the Heirs at Law of Henry Bushong
deceased and vested in complainant Subject to the life estate of the Said
defendant Elizabeth as provided for in the last will and testament of David Bushong
deceased annexed to complainants Bill as exhibit B. It is therefore
accordingly ordered adjudged and decreed by the Court that the legal title to the

Thousand eight hundred and twenty between Henry Bushong of the County of
Shenandoah and State of Virginia of the one part and Walter Newman of the same
county and state aforesaid of the other part. WITNESSETH that the said Henry
Bushong in order to secure the payment of the following debts VIZ Four hundred
and seventy nine dollars and 65 cents due March 20, 1820 to Anderson Moffett
Jr. One hundred and fifty one dollars due 5th October 1820 to same Newman and

bedsteads and furniture, 6 tables, 2 bureaus, 2 chests, 1 cupboard, one tin plate,
stove, and pipe, 1 large copper kettle, 1 ditto tea kettle, 12 potts
different sizes, 2 Dutch ovens, 1 frying pan, 1 iron kettle, 6 wash tubs, 2 apple
mills, 1 dozen chairs, 2 dozen pewter plates, 1 dozen large pewter dishes, 1
dozen glasses, goblets, 2 sets cups and saucers, 1 dozen bowls, 2 dozen plates,
1 dozen large dishes and two mens saddles. TO HAVE AND TO HOLD the said
property herein before mentioned to be hereby granted unto the said Walter Newman
his heirs, executors, administrators and assign for ever upon Trust never
the less that the said Walter Newman shall as soon as conveniently he can after
having advertized the time and place of the sale of the property before
mentioned in some public newspaper published nearest to the residence of the said
Henry Bushong proceed to sell the same to the highest bidder for the best
price that can be attained and out of the money arising from the sale in the
first place to pay and satisfy all reasonable charges attending such sale and
then the debts herein before mentioned and the residue of the money arising
from such sale so aforesaid to the use of the said Henry Bushong his executors,
administrators or assign or to such person or persons as he by writing under
his hand shall appoint and is default of such appointment to such person or
persons as would be thereto entitled by virtue of the statute for distribution
of Intestates Estate and it is hereby covenanted and agreed by and between
the said parties to this Indenture that the trusts hereby declared shall cease
on the payment of the several debts herein mentioned at or before the
expiration of two years from this date otherwise to remain in full force and virtue.

The book was transcribed in the 1930's and she has since computerized

of James King Jacob Hawk John Wassons and the plantation on which I now live

having heretofore given unto my son George and daughter Sally and my daughter
Elizabeth certain property I now give and bequeath unto each of them one dollar.
ITEM. I further desire that the balance of my perishable property shall
be sold three months after my decease by my Executors hereafter named on a
Credit of nine months and further it is my desire that the plantation on which I
now live being the same I purchased of Thomas Vance formerly the property of
Edward Richards ded. bounded by the lands of John Wasson John Vance Jonathan
Wasson and the heirs of Joshua Richards and the plantation I bought of
Hennery Bushong shall be sold three months after my death then third part of the
purchase money to be paid in hand and one third in Twelve months and the
remaining third in Two years after my death and out of the moneys arising
therefrom of the real and personal property it is my desire that my Just debts and
funeral expenses shall be paid and after the payment of my Just debts and
funeral expenses should there be a residue remaining I give the same to my
children herein after named to be equally divided between them that is to my son
George my daughter Sally my daughter Elizabeth my son David my son Jacob my son
John and my daughter Catharine to be divided between them and their heirs.
AND LASTLY I do appoint and Constitute my sons George Bushong and David
Bushong Executors of this my last will and Testament revoking all former wills
and testaments by me heretofore made in witness whereof I have here unto set
my hand and affixed my seal this Twenty eighth April in the year of Our Lord
Eighteen hundred and Twenty Seven.

said David Bushong at or before the sealing and Deliverying of these presents

This cause coming in for final hearing the 7th Day of February 1837 before
the Honorable Thomas L. Williams Chanceller upon the Bill of the Complainant
exhibits and proofs and it appearing that Judgment pros sessions have been
regularly entered against the defendants and the cause set down for hearing
exparte according to the course of the Court and the Chanceller being of opinion
that the complainant is entitled upon the part of the conveyance from the
defendant Philip Bushong to complainant Marked Exhibit C to complainants Bill to
have the legal title to Tract of land in exhibit A to complainants Bill
described divested out of the defendants the Heirs at Law of Henry Bushong
deceased and vested in complainant Subject to the life estate of the Said defendant
Elizabeth as provided for in the last will and testament of David Bushong
deceased annexed to complainants Bill as exhibit B. It is therefore accordingly
ordered adjudged and decreed by the Court that the legal title to the Tract
of land in the Bill and in the exhibits A, B, and C there to annexed be and
the same is hereby vested out of the defendants the Heirs at Law of the Said
Henry Bushong deceased and out of all other persons and the same is hereby
vested in in the complainant to take effect and be complete instantly upon the
death of the defendant Elizabeth Bushong widow of the Said David Bushong but
not sooner. AND it is further ordered that the complainant pay the costs of
this cause in the first instance and that he have a decree entered against
Philip, Jacob, Henry, Solomon, Jonathan, and Sally Bushong the heirs at Law of
Henry Bushong for the full amount of Said Costs so by him paid which is ordered
and decreed accordingly.

I Seth I. N. Lucky Clerk and Master of the Chancery Court at Jonesborough
for the first Chancery District composed of the counties of Washington & c. do
certify that the foregoing is a correct coppy of the decree in the cause
